The JEP Procedures Law: successes, weaknesses, and challenges of criminal law in contexts of transitional justice

This study discusses the main successes, weaknesses, and challenges of the Procedures Law of the Special Jurisdiction for Peace (JEP), based on national and international law, especially from the constitutional perspective of international human rights law and international criminal law.

This study is of utmost importance as it focuses on concrete and operative aspects at the heart of the implementation and consolidation of the peace agreements, and because it advances academic research and reflection on peacebuilding. For example, it may help explain the processes that applicants have to undergo, and the role of victims who seek reparation according to their rights.

The study will produce input that may give rise to future debate and research, and that may be used by legal operators in charge of implementing the new jurisdiction.
